Booking Conditions

Payments can be made via cash, direct deposit, credit card (Visa, Mastercard) or PayPal. Payments made by direct deposit must be received no more than 10 days after booking, if the tours is less then 10 days away from the time of booking you must use another payment method. Cash payments are only accepted for in person bookings. 
Please choose carefully before you book. The following fees apply on cancellation.
 
Nature Play & Kids in Nature Programs
  • Full term – no refund if cancelled less then 14 days before first session – no transfers
  • Casual – no refund if cancelled less than 7 days before session – no transfers
  • Casual – sessions can be transferred to another date if cancelled 7 days before the session
Outdoor Education

Unless otherwise stated, if for any reason you need to cancel your booking, the following conditions apply: 

  • Booking cancelled within 90 days of arrival: Loss of deposit 
  • Booking cancelled within 60 days of arrival: 50% of total expected booking value 
  • Booking cancelled within 30 days of arrival: 75% of total expected booking value 
  • Booking cancelled within 7 days of arrival:  100% of total expected booking value 
Micro & Half Day Tours (excluding private tours)
  • Cancellation fee of 100% is charged if cancelled less than 1 day before the event – no transfers
  • Cancellation fee of 50% is charged if cancelled less than 7 days before before the event – or transfer to anther date
  • More than 7 days before the event – partial refund (10% admin fee retained) or transfer to another date
Full Day Tours (excluding private tours)
  • Cancellation fee of 100% is charged if cancelled less than 1 day before the event – no transfers
  • Cancellation fee of 75% is charged if less than 2 days before the event – if transfer is not chosen
  • Transfer fee of 50% is charged if less than 2 days before the event (i.e. full booking price + 50% must be paid in total for new booking date due to catering)
  • Cancellation fee of 50% is charged if cancelled less than 7 days before before the event – or transfer to anther date
  • More than 7 days before the event – partial refund (10% admin fee retained) or transfer to another date 
Multi Day Tours (excluding private tours)
  • Cancellation fee of 100% if booking is cancelled less than 2 weeks prior to departure – no transfers
  • Cancellation fee of 50% if booking is cancelled more than 2 weeks prior to departure – no transfer
  • Transfer fee of 50% is charged if cancelled more than 2 weeks prior to departure (i.e. full booking price + 50% must be paid in total for new booking date to cover accommodation costs) 
We strongly recommend that you obtain suitable private travel and/or cancellation insurance for your booking. If you pay by credit card you may like to check whether cancellation insurance is included.
  • If a customer cancels a tour after commencement, no refund will apply.
  • We may, at our sole discretion, reduce, transfer or waive your loss of fare for any reason.
  • Any changes to tours may incur an administration fee of $50.
  • Failure to show for a course, trip or activity will result in loss of tour fare. Late arrival for your tour may result in forfeiture of tour fare.
There will be no refunds for cancellations due to acts of God (including weather related cancellations), natural disasters, or epidemics. We will do our best to reroute the tour or transfer your booking to another date. We reserve the right to change the tour location, duration, stops and/or destination for safety purposes. 

Participants under the age of 18 must have a tour waiver form completed by their parent or guardian.
Participants under the age of 18 must be accompanied by a parent or guardian, except where prior arrangement has been made with management (e.g. kids in nature & outdoor education programs). Not all of our tours are appropriate or available for people under the age of 18. Please call our office to confirm before booking.

Minimum customer numbers apply for our tours. Where sufficient numbers are not achieved, we reserve the right to cancel the tour or offer a suitable alternative tour (subject to a payment for any price difference at our discretion). Alternatively, you may be given the option to pay a surcharge and proceed with the tour as booked.

We will contact you (the day before your trip for day excursions or 5 days prior for overnight excursions) if minimum numbers are not achieved to discuss your options. If this is not agreeable to you, then please see our cancellation policy.

Any special requirements for customers must be notified to us at the time of booking. This includes but is not limited to physical disabilities, medical conditions, and dietary requirements.

A customer may be removed from any tour for any reason by us.
We reserve the right to deny access to tours for anyone who in our opinion is drunk, disorderly, a hazard to themselves or others, abusive, not physically able, mentally incapable, or objectionable in any other way. We will not be liable for any additional expenses incurred as a result of your removal or non participation.

Risk Warning & Liability Waiver

The following is important information which affects your legal rights and obligations.
 
PLEASE READ THE FOLLOWING CAREFULLY. DO NOT AGREE UNLESS YOU ARE SATISFIED THAT YOU UNDERSTAND IT.
 
The events and/or activities you are about to embark on can lead to injury, damage and possible loss of life. 
In consideration of the provision of services by Kea Adventures Pty Ltd trading as Tomaree Coastal Adventures, their directors, leaders, agents, owners, officers, volunteers, participants, employees, and all other persons or entities acting in any capacity on their behalf (the ‘Organiser’), you agree to release, indemnify, and discharge the indemnified parties, in accordance with the terms of this agreement. 

Occasionally, photos and video-taping will be taken during activity and may be used by ‘the Organiser’ for publications including its Website and Facebook page. However, we will not identify you or your child by name or release any personal information.

Permission is hereby given for the staff of ‘the Organiser’ whom are CPR/first aid certified to administer CPR and/or first aid as deemed necessary. Further permission is given to allow medical services to be performed by doctors, hospitals or other qualified medical providers as deemed necessary in an emergency, including surgery if reasonably necessary. I understand that the cost of all emergency services is my responsibility.

Many of our tours are conducted in sensitive areas. We love providing you with access to these natural wonders but ask that you respect and protect this wondrous resource. Please do not interfere with, pick up, alter or remove any plant, animal or other natural, historical or cultural feature. Please stick to formed paths, carry all your rubbish out with you and use minimal impact toileting procedures.

This is a facilitated activity. Your guide is there to show you and your children how to connect with and enjoy nature. You acknowledge and accept that it is your responsibility to ensure that you and your child participates only in those activities for which you and your child has the requisite skills, training and physical conditioning. You are responsible for your child at all time and you agree that you will follow (and ensure that your child follows) the safety guidelines as requested by your our staff. Due to this we will enforce a maximum ratio of 1 adult caregiver to 3 children – including infants. If you turn up with a higher child to adult ratio and no other attending adult is prepared to make up the difference you will be turned away with NO REFUND. This is for your children’s safety.

The activity undertaken entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to you, your property, or to third parties. Such risks cannot be eliminated without jeopardizing the essential qualities of the activity. These risks can include but are not limited to:  
  • falling at edges of cliffs or elsewhere 
  • rough terrain, obstacles slippery and/or uneven surfaces in and around water, cliffs, rock formations, stairs and/or along beaches and headlands   
  • over-exertion and cardiovascular stress 
  • heat, cold and adverse weather conditions 
  • plant and animal life including stings and bites
  • swimming in patrolled and un-patrolled areas  
  • rocks being dislodged  
  • hypothermia and heat exhaustion
Please note: 
  • There is also the risk that due to the remoteness of some of the locations, medical, evacuation or search services might be slow 
  • The activity may be physically demanding 
  • The activity may involve exposure to the natural elements and extreme weather and other circumstances or take place in remote, harsh & unpredictable environments 
To the extent permitted by law, you release and hold harmless the Organiser from and against any liability arising out of any injury, loss, damage or death caused to you or your property or any other person arising from or in connection with your participation in the activity whether such injury, loss, damage or death was caused directly or indirectly by negligence, breach of contract or any way whatsoever other than where the injury, loss, damage or death was caused solely by the gross negligence of the Organiser. 
You agree:
  • To indemnify and keep indemnified and hold harmless the Organiser from any and all claims, demands, or causes of action, which are in any way connected, either directly or indirectly, with your participation in the Activity or your use of The Organiser’s equipment or facilities, including any such claims that allege negligent acts of or omissions by the Organiser. 
  • That you are, at your own risk and by your own choice, participating in a dangerous recreational activity. 
  • To follow all rules, instructions and directions provided by the organiser in connection to the activity.  
  • That you will be participating in this activity with other people who may cause you injury or damage your property in the course of the activity. 
  • That you may cause injury to other participants or damage their property in the course of the activity 
  • That you agree with the booking conditions provided during the booking process – also available on our website   
  • If agreeing on behalf of a minor, that you are eligible to give permission for participation in activities
You warrant that you:  
  • Are physically fit and able to undertake and participate in the Activity, and a medical professional has not advised you otherwise;  
  • Are not a danger to yourself or to the health and safety of others; and 
  • Have no medical, psychological or physical conditions that would interfere with your safety in the Activity and you are willing to assume, and bear the costs of, all risks that may be created, directly or indirectly, by any such condition.
